They don't control the Supreme Court. Not yet anyway. And even if they manage to get Gorsuch confirmed (and that's a big if), it will still be a 4-4 split with Kennedy often being a swing vote. For example, over the past 11 years on the Roberts Court, there have been 16 cases in which the justices split 5-to-4, strictly along ideological lines. Kennedy joined the conservative wing of the court 11 times; the liberals, 5, one being the decision to legalize same-sex marriage in 2015. In fact, he authored the majority opinion in that case.
